COLEMAN & FISH’N CANADA CONTEST

Official Rules and Regulations

1.   NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A purchase will not improve your chances of winning. The Coleman & Fish’n Canada contest ("Contest") starts at 12:00:01 pm Eastern Time ("ET") on September 9th, 2009 and ends at 11:59:59 p.m. ET on October 14th, 2009. The sponsor of this Contest is Sunbeam Corporation (Canada) Limited, 20 Hereford Street, Brampton, ON L6Y 0M1 (the "Sponsor"). The Contest shall be subject to these Official Rules and Regulations (the “Rules”) available at www.colemancanada.ca. By entering, all participants agree to be bound by the terms and conditions of the Rules.

  

2.   ELIGIBILITY. CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF CANADA who have reached the age of 18 or the legal age of majority according to their province/territory of residence AS OF THE DATE OF THEIR ENTRY; except employees of Sunbeam, it's affiliates, their respective advertising and promotional agencies, the independent judging organization, and members of their respective immediate families living in the same household; subject to approval from the Regie des alcools, des courses et des jeux regarding the Province of Quebec. ALL ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON October 14th, 2009. Entrants who do not follow the Rules will be disqualified.

  

3.   ENTRY FORM. To enter, completely fill out the electronic entry form and upload your photo(s) and story (the "Content"). Entry form available online at www.colemancanada.ca (the “Website”). Limit of one entry per person, 5 per household. Photos will be accepted only in electronic format from the original photographer. Photographs that are claimed to have infringed any third party’s rights will be disqualified. Digital photos shot with a camera must have a minimum resolution of at least 2 mega pixels and a maximum file size of 4mb. Digital photos that are scanned must be scanned at a resolution of at least 150 lines per inch or equivalent with a minimum output size of 5"x7". All submitted photographs must be in JPG format. By submitting a photograph and/or story, you do hereby grant, convey, sell, assign, and transfer to Sponsor, its successors and assigns, as assignee, all of your right, title, and interest in and to the Content, the copyrights to the Content, any registrations and copyright applications relating to the Content and any extensions and renewals thereof, all droit morale rights to the Content, and any derivative use of the Content, including, but not limited to, the sole and exclusive right of copying, engraving, reproducing, and multiplying the Content in any form in any medium. You further warrant and represent that: (a) you are the sole owner of the Content, including but not limited to, all copyright rights therein and the story; (b) you have the authority to enter into this assignment; (c) this assignment does not infringe any third parties rights; (d) the Content has not been published in such a way as to lose any of its copyright protection; and (if) you have the necessary rights from each person and identifiable location to grant the assignment. (e) there is no pending or threatened lawsuits concerning any aspect of the Content. You hereby confirm that upon submission of the Content, Sponsor and its successors and assigns, shall own the entire title, right and interest in the photograph(s) free of any restrictions, including the right to reproduce, prepare derivative works based upon the copyright in the Content, distribute by sale, rental, license, lease or lending or by other transfer of ownership, to display, and to make publicly available for download by means of the Internet, the Content. You retain no rights in the Content. Sponsor is not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; congestion, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing; administrative or other errors of any kind or any combination thereof. Proof of entering information at the Website is not considered proof of delivery or receipt. Illegible, incomplete and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Rules and with the Sponsor’s Online Privacy Policy.

 

4.   PRIZES One (1) Grand prize will be awarded for best overall photo/story, judged from all entries submitted. Grand Prize consist of one (1) Roadtrip® Grill LXE, item # 9949-750C. The approximate retail value of the Grand prize is $319.99. Due to inventory control and/or product development Sponsor reserves the right to substitute any item with one of greater or equal value.

 

5.   WINNER SELECTION. - The photos/stories will be judged by a panel of not less than 4 judges. A decision will be made on October 21st, 2009 by at 1:00 p.m. from all eligible entries received on or before 11:59 PM ET October 14th, 2009. In order to win, the selected entrant must first correctly answer a time-limited, mathematical, skill-testing question without assistance or mechanical or electronic aid. All decisions of the independent judges are final.

 

6.    WINNER NOTIFICATION. Winner will be notified by email or telephone week of October 21st, 2009. Winners will be required to complete, execute (notarize) and return a standard Affidavit of Eligibility, a Winner’s Release and Assignment Form confirming compliance with these Rules and acceptance of the prize as awarded and if required such other agreements as are necessary to secure for Sponsor the rights required by the Rules, including a Model Release form to be completed by all individuals depicted in the winning photo. The Affidavit and Winner's Release and Assignment form, and Model Release Form if applicable must be returned within 14 days of receipt. Failure to return all required documents in this time period will result in the winner being disqualified and an alternate winner selected.

 

7.   PERSONAL INFORMATIONInformation gathered from the online entry form is for the sole use of Sponsor in connection with the Contest. Personal Information (your name, address, telephone number and email) will not be passed on to any other organization or group for the purpose of solicitation. No correspondence will be entered into except with the selected entrants who will be notified by email or telephone. By entering the contest, each entrant consents to the use of their name, address (city and province only), likeness (photograph) and fishing story in any publicity carried out by Sponsor without compensation or limitation.

 

8.   Sponsor reserves the right to terminate or modify the Contest in any way that it deems to be fair and equitable in the event of an occurrence which may materially affect the proper play of the Contest. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.

 

9.   Subject to paragraph 8, if for any reason this Contest is not capable of running as planned, or if this Contest or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Contest or any portion thereof. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Website. Any attempt by any person to deliberately damage any web site or undermine legitimate operation of the program is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to disqualify and seek damages from any such individual to the fullest extent permitted by law. In the event of dispute over source of any electronic entry, the entry will be attributed to the authorized account holder of the email account. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.

 

10. No substitution for, or transfer of, or cash equivalent, of prizes will be allowed. The chances of being selected depend upon the total number of entries received. Void where prohibited. The contest is subject to all applicable Federal, Provincial and Municipal laws.
